What Is The Clean Air Act?

The Clean Air Act is the primary federal law governing outdoor air pollution in the United States. Congress passed the first federal air legislation in 1955, expanded it in 1963, then rebuilt the statute in 1970, a sequence EPA traces in how the Clean Air Act evolved. The 1970 law gave the new Environmental Protection Agency power to set national health-based standards and required states to write enforceable plans to reach them.

How The Clean Air Act Actually Works

The Clean Air Act works through a division of labor. EPA sets national standards for six criteria pollutants, and each state writes a plan to meet them. Primary standards protect human health, including children, older adults, and people with heart or lung conditions. Secondary standards protect crops, buildings, ecosystems, and visibility.

EPA reviews the science on a recurring cycle and revises a limit when evidence supports it. A county exceeding a standard falls into nonattainment, obligating the state to add controls. Separate federal programs cover tailpipe emissions, fuel content, and new industrial sources, since pollution drifts across state lines.

What The Clean Air Act Achieved From 1970 To 2024

What The Clean Air Act Has Not Solved

Three problems have outlasted the law's first 55 years: ground-level ozone, a fine-particle trend that stalled after decades of decline, and an exposure burden that never spread evenly. Ozone remains widespread across the Sun Belt and interior West. Roughly 109 million people lived in counties above at least one primary standard in 2024, by EPA's count. The American Lung Association's 2026 State of the Air report found 152.3 million Americans, 44 percent, in counties failing on ozone or particle pollution.

That burden falls unevenly. The same report found people of color more than twice as likely to live in a county failing all three measures.

Regulatory Air Versus The Air You Actually Breathe

Two gaps separate the air the Clean Air Act measures from the air a family actually breathes. The first is wildfire smoke, which the law permits states to strike from the compliance record. The second is the front door, since the statute governs outdoor air and stops there. Both have widened as fire seasons grew longer.

Under Section 319(b) and EPA's Exceptional Events Rule, a state may ask EPA to exclude monitoring data caused by events outside its control, and wildfires qualify. EPA publishes tools for preparing these demonstrations. The particles still entered lungs. They simply stop counting toward the compliance record. Researchers at Resources for the Future call this a widening divergence between actual and regulatory air quality, and it grows as fires grow. The National Interagency Fire Center recorded 77,850 wildfires burning 5,131,474 acres in 2025.

What The Law Never Reached Indoors

The gap is easier to see when you name what falls inside it. A gas range raises nitrogen dioxide in a kitchen. Cooking puts fine particles into the rooms your family sleeps in, and so do candles and a wood fireplace. Radon rises from the soil under the slab. Household products release volatile organic compounds. EPA publishes guidance on all of it and enforceable limits on none of it, because the statute stops at the property line. Where The Clean Air Act Stands In 2026

The primary annual PM2.5 standard is 9.0 micrograms per cubic meter, and as of June 2026 it has survived a challenge from industry and from EPA itself. The D.C. Circuit upheld the limit EPA set in 2024, rejecting petitions from states and industry groups and denying the agency's request to vacate the rule it had issued.
